Ocho exalumnos del colegio Héctor de Cárdenas,
ubicado en Jesús María
[en Lima] denunciaron penalmente al exdirector de
esta Institución Educativa por el delito
contra la libertad sexual con el
agravante de lesiones sicológicas graves, manifestó
ayer el abogado José Ugaz.

“El señor Juan Borea
cometió el delito contra mi libertad sexual al
realizarme masajes cuando hacía ejercicios en
2001 cuando tenía once años. Se aprovechó de mi
condición de niño y del desconocimiento sobre
mis derechos sexuales. He presentado, junto a
otros siete exalumnos, una denuncia penal contra
Juan Borea y ahora el caso está en manos de la
Fiscalía”, declaró Alonso
Marañón Tovar.
Los otros siete denunciantes son: Rafael
Salgado, Yehude Simon hijo, Daniel Kudó, Javier
Olivera, Nicolás Cabieses, Sergio Gutiérrez y
Gabriel Acevedo. El peligro de la
prescripción podría dejar impune este caso.
“Hay la amenaza de la prescripción,
efectivamente, porque lamentablemente en el
sistema jurídico peruano los delitos que se
cometen en agravio de menores contra su libertad
sexual tienen un periodo de prescripción de seis
años. En este caso, no solo estamos denunciando
delitos de tocamientos indebidos, sino también
el delito de lesiones sicológicas graves que
viene como consecuencia de los tocamientos
indebidos. De acreditarse que hay situaciones
graves, además del agravante de que el agente
que comete el delito tenía posesión de autoridad
como director de colegio, hay posibilidad de que
la acción penal no prescriba, para los casos más
recientes de 2001 y 1999”, explicó
Camilo Clavijo, abogado del equipo del caso dirigido
por [el abogado] Ugaz.

De acuerdo con los denunciantes, el 'modus operandi'
de Borea era elegir a niños entre
once, doce y trece años -con problemas económicos y
emocionales- para ganarse su confianza y,
posteriormente, “llevarnos a un sitio apartado donde
cometía sus delitos”.
“Son treinta y tres años que Juan Borea fue
director del colegio, ¿a cuántos niños más habrá
abusado? Y el colegio Héctor Cárdenas (fundado
por el mismo Borea) no ha ejecutado ninguna
sanción. Él dejó la dirección por su decisión,
pero lo hemos visto merodeando el lugar, en
busca de nuevas víctimas”,

secondary school in the Jesús-María

sexual liberty when he performed massages on me at
the age of 11. He exploited my condition as a child

[Borea's tactics: Talk to young people about
problems - and invite and abuse them]
According to the complainants, the perpetrator Borea
had a repetitive "scheme of action" to select
children between eleven, twelve and thirteen with
economic and emotional problems in order to gain
their trust and later "to bring them to a secluded
place where he committed the crimes".
"Mr Borea has been the director of the secondary
school for 33 years, how many children will he still
have abused, and the Héctor Cárdenas school founded
by Borea itself has not imposed any sanctions, he
left the directorate of his own free will, but we
have seen as he roams the place in search of new
